美國司法 內容介紹：
《美國司法》中介紹美國刑法雖源於英國普通法，但更傾向於通過立法規定犯罪和刑罰。美國近現代除了聯邦和州的刑事立法之外，美國曾沿用英國普通法的犯罪分類。現在聯邦和各州刑法典一般把犯罪分為重罪和輕罪兩大類，有的還依據《模范刑法典》附加次輕罪、違警罪等分類。美國除按“等”對犯罪分類外，還對“等”分“級”，各州的劃分也不統一。
《美國司法》中介紹美國接受犯意的概念。現代英美刑法只考慮犯意，而不考慮動機。但不同的犯罪對犯意有不同的要求。美國的刑罰有死刑、監禁、緩刑、監禁與緩刑混合刑、賠償損失、公眾服務和罰金。美國的死刑從19世紀中葉開始在一些州被廢除，20世紀有更多的州廢除死刑。但後來有一些州恢復了死刑。1976年聯邦最高法院認為保留死刑是完全必要的。
